PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. YOU (EITHER AN INDIVIDUAL OR A SINGLE ENTITY) AGREE THAT THESE TERMS AND CONDITIONS ARE ENFORCEABLE LIKE ANY WRITTEN CONTRACT SIGNED BY YOU.
By downloading, installing and using a Medialooks product, you agree with the terms & conditions of this Agreement.
Medialooks offers a free 30-day evaluation (trial) license for all its products. The purpose of the evaluation license is to test, build prototypes and demo. It is prohibited to distribute or deploy Medialooks software with or without an evaluation license. A full commercial license has to be obtained for redistribution or deployment.
3. License types
There are two license types:
Single Developer license. This license grants the right to use a product by one developer. There are no limitations on the number of executable applications, as well as deployed or distributed copies.
Team license. The same as Single Developer, but valid for 4 developers.
4. License validity, updates & support
With every license we provide a perpetual deployment license and a 1 year subscription for updates (the ability to deploy new releases) and support. See this FAQ post for clarification.
Once expired, this subscription can be renewed with the following discounts from the full price of the license at moment of renewal:
- 50% if renewed within 3 months upon expiration
- 25% if renewed within 1 year upon expiration
No discount will be provided after 1 year from subscription expiration date.
We require that at least one working email address is subscribed to occasional mailings with new features and fixes to the licensed products. We reserve the right to make occasional cross-promotions to inform you about related products and add-ons.
Support is provided via an online ticketing system available in the Support section of our web site. In order to submit a support case, you need to be a registered user.
Support is provided only for the latest non-beta versions of our products. The option to download any particular version is provided during one year since its release date.
If a product is discontinued, support will be provided until the expiration of the current subscription period. The option to renew the subscription will not be provided. Instead, a migration path to a replacing product may be offered.
5. Payment & delivery
Delivery of license files is made within 48 hours after receipt of payment by Medialooks. Delivery is made in electronic form via either email or download. The default validity of all invoices or payment links is 30 days.
6. Third-party licensing
Licensing of third-party components or patents (such as those from Apple, MPEG LA or Dolby), that may be used together with our products or be an integral part of them, is your responsibility. This may be especially important for Decoder lib, Encoder lib and the Multi-format source DirectShow filter.
7. License limitations
Medialooks software shall not be used to create products that target developers, programmers or software engineers such as, but not limited to software development kits, libraries (LIBs and DLLs), COM/ActiveX, .NET components or toolkits. Your application should not expose any of its functionality through an application programming interface (API) unless expressly permitted by Medialooks. If you are not sure whether this applies to your application, please contact us.
Your licenses cannot be transferred to a third party without written permission from Medialooks.
If you want your application to be distributed by a third party under an OEM agreement, please contact us to obtain a separate license.
8. Intellectual property
Any comments or materials sent to Medialooks through this website or any other means, including all feedback, questions, comments, suggestions, functions and features you would like to see, questionnaires and the like, shall become the sole property of Medialooks. Such comments and suggestions shall not be confidential,
and Medialooks shall be free to use any such suggestions, comments, concepts and the like for any and all purposes of its sole choosing, without restriction and without payment of any compensation. You have no obligation to submit any comments or suggestions to us.
9. The use of FFmpeg
FFmpeg is an open source library licensed under the LGPL version 2.1.
FFmpeg is a trademark of Fabrice Bellard, originator of the FFmpeg project.
10. Right of Reference
Medialooks may, on its website, in its documents, brochures and other promotional materials, state that you are a customer to Medialooks. However, we are likely to waive this term upon request.
We may terminate your license if this Agreement is breached. License files shall be permanently deleted. No refunds will be provided.
12. Disclaimer of warranty
THERE IS NO WARRANTY FOR THE PRODUCTS, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE STATED IN WRITING MEDIALOOKS PROVIDES THE PRODUCT “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PRODUCT IS WITH YOU. SHOULD THE PRODUCT PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
13. Limitation of liability
IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL MEDIALOOKS BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCT (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE PRODUCT TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This Agreement is subject to change. Changes will become effective for all product versions released after the change has been made. We are likely to notify about important changes via email.
